Terms of Service

These Terms of Service govern your purchase and use of the GrowthLeaks audit service. By completing a purchase, you agree to these terms. GrowthLeaks is operated by 410 Strategy Group, based in Billings, MT.

Please read these terms carefully before purchasing. If you have questions, contact us at [email protected] before placing an order.

1. Services

GrowthLeaks offers a Website and Google Business Profile (GBP) Audit bundle. Upon purchase, we research your business using publicly available information and deliver a scored audit report covering your website performance, local SEO presence, and Google Business Profile optimization.

Reports are generated using a combination of automated analysis tools and AI-assisted content generation (Anthropic Claude API). Reports are reviewed for quality before delivery.

Google Business Profile Optimization ($300, one-time). A done-for-you service: we perform a full teardown of your Google Business Profile and apply the fixes — categories, fields, service descriptions, photos, review link and ask system, Q&A, and first posts — in one optimization pass. This service requires you to grant GrowthLeaks manager access to your Google Business Profile; work begins once payment is received and access is granted, and the timeline is confirmed with you at purchase. Optimization improves the completeness and correctness of your profile; no specific ranking outcome is guaranteed (see Section 6).

GrowthLeaks is operated by 410 Strategy Group. Your contract for service is with 410 Strategy Group.

2. Payment

All prices are displayed and charged in US dollars (USD). Full payment is required before any audit work begins — no exceptions.

Payments are processed securely by Stripe. We do not store your card details. By providing payment information, you authorize the charge for the amount shown at checkout.

Pricing may change for future orders. The price shown at the time of your purchase is the price you pay — no surprises.

3. Refund Policy

No refunds on delivered reports. Because your audit report is a custom-generated digital product, all sales are final once your report has been delivered to the email address provided at checkout.

If you have not received your audit within 24 hours of payment confirmation, contact us at [email protected] and we will resolve it promptly.

4. Delivery

Your audit report will be delivered to the email address you provide at checkout within 24 hours of payment confirmation. Delivery is automated in most cases.

If our automated system encounters a problem, we will fulfill your order manually and still target delivery within 24 hours. If a delay is expected beyond that window, we will notify you by email.

Accurate delivery of your report depends on you providing a valid, accessible website URL and Google Business Profile URL at checkout. We are not responsible for delays caused by incorrect or inaccessible submissions.

5. Report Use

Your audit report is created specifically for your business and is licensed to you for personal and business use. You may share it internally, act on its recommendations, or show it to partners and vendors.

You may not resell, redistribute, or represent the report as your own work product to third parties. Reports generated for one business are not transferable to another.

6. Accuracy of Reports

Audit reports are based on publicly available data at the time of the audit. Website and GBP scores reflect conditions observed during the research window and may not account for recent changes to your site or listing.

Recommendations in your report represent best practices and our professional assessment. We make no guarantees about specific business outcomes — including revenue, leads, or search ranking improvements — that may result from implementing our recommendations. Results vary based on your market, competition, and how recommendations are applied.

If you believe a significant data error was made in your report, contact us at [email protected] within 14 days of delivery and we will review it.

7. Limitation of Liability

To the maximum extent permitted by applicable law, 410 Strategy Group's total liability for any claim arising from or related to GrowthLeaks services is limited to the amount you paid for the service giving rise to the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost revenue, lost data, or lost business opportunities — even if we have been advised of the possibility of such damages.

8. Intellectual Property

The audit report content we deliver to you — the written analysis, scores, and recommendations specific to your business — is yours to use as described in Section 5.

The GrowthLeaks name, logo, brand identity, report templates, scoring methodology, and underlying software are the property of 410 Strategy Group. Nothing in these terms transfers ownership of our intellectual property to you.

9. GrowthLeaks Portal — Subscription Plans & Acceptable Use

This Section 9 applies to the GrowthLeaks Portal — our hosted AI workspace offered on monthly subscription plans (currently Beginner, Pro, and Business). Where this section conflicts with other sections, this section controls for Portal subscriptions.

9.1 Subscription & billing

Portal plans are billed as a recurring monthly subscription. By subscribing, you authorize us (through our payment processor, Stripe) to charge your payment method automatically each month until you cancel. Your subscription renews automatically at the then-current price for your plan.

9.2 Bring Your Own AI (BYOP)

Portal plans require you to connect your own third-party AI provider account (for example, Anthropic or OpenAI) using your own API key or login. You are solely responsible for your AI provider's fees and for complying with that provider's terms. We do not resell, mark up, or control your AI usage, and we are not responsible for your AI provider's availability, pricing, or output. AI-generated output is provided "as is"; you are responsible for reviewing it before you rely on or publish it.

9.3 Hosting & access

Where we host your instance, your subscription grants you a limited, non-exclusive, non-transferable right to access and use the Portal during your paid subscription. It does not transfer ownership of the software, workflows, templates, or underlying systems to you.

9.4 Failed payment, suspension & freeze

If a renewal payment fails, our processor will attempt to retry the charge. If payment is not successfully updated, we may suspend (freeze) your access until your billing is brought current. During a freeze your workspace and data are retained but you will not be able to use the Portal. Continued non-payment may result in termination of your subscription and, after a reasonable period, deletion of your instance and data. You can update your billing at any time through the billing portal we provide to restore access.

9.5 Cancellation

You may cancel at any time. Cancellation takes effect at the end of your current billing period; you retain access through the period you have already paid for. Except as stated in Section 3, fees already paid are non-refundable, and we do not provide prorated refunds for partial months.

9.6 Acceptable Use

You agree not to use the Portal to create, store, send, or automate any content or activity that is: illegal; infringing on others' intellectual property; sexually explicit or adult; hateful, harassing, threatening, or defamatory; deceptive, fraudulent, or misleading (including spam and unsolicited bulk messaging); malware, or intended to breach, disrupt, or gain unauthorized access to any system; or that violates the terms of any connected third-party service. You also agree not to resell, sublicense, or share your access, or to use the Portal to build a competing product from our workflows, brains, or templates.

Violation of this Acceptable Use policy may result in immediate suspension or termination of your account at our sole discretion, and any fees paid may be forfeited. You are responsible for all activity that occurs under your account and for the content and connected accounts you use with the Portal.

9.7 Your content & data

You retain ownership of the content and data you bring into or create with the Portal. You grant us the limited right to host, process, and access it as needed to operate, secure, support, and improve the service. You are responsible for having the rights to any data you connect, and for complying with laws that apply to it.

9.8 Availability

The Portal is provided on a best-effort basis without a guaranteed uptime commitment at these plan levels. We may perform maintenance, update or change features and workflows, and set reasonable usage and resource limits.

10. Changes to Terms

We may update these Terms of Service from time to time. When we do, we will update the "Last updated" date at the top of this page. Changes take effect immediately for new purchases. If you have an active order in progress at the time of a change, the terms in effect at the time of your purchase apply to that order.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of GrowthLeaks services shall be subject to the exclusive jurisdiction of the courts located in Yellowstone County, Montana.
